Terms of Use and Legal Notice

Last updated: 3 November 2026

1. Website operator

This website, https://zinkea.com, is operated by Zinkea Business Consulting, S.L. ("Zinkea", "we", "us" or "our").

These terms explain the permitted use of our public website and the materials made available through it. Please read them before using the website and retain a copy if needed. Any contractual effect of these terms is subject to the requirements of applicable law.

2. Purpose and scope

Zinkea presents research, computational modelling and advisory activities concerning complex economic, organisational and social systems. The website provides general information about these activities and a means of contacting us.

These terms concern the public website. They do not establish the terms of a paid advisory engagement, research collaboration, software subscription or other professional service. Where separate written terms or an express licence apply to a particular service or resource, those terms govern that service or resource in the event of a conflict, subject to mandatory law.

3. General information and professional engagements

Website publications, descriptions, examples and demonstrations provide general information. They do not constitute advice tailored to your circumstances or a recommendation to undertake a particular transaction, investment, organisational change or other course of action.

Browsing, downloading materials or sending an enquiry does not by itself establish a client, fiduciary, partnership or advisory relationship, or oblige either party to enter an engagement. Professional work requires a separate agreement covering its scope, deliverables, fees, responsibilities and other applicable conditions.

Obtain advice appropriate to the decision and its circumstances before relying on website materials. Nothing published here is an offer to buy or sell a financial instrument or a substitute for legal, tax, accounting or regulated investment advice.

4. Research, models and demonstrations

Research findings, conceptual frameworks, simulations, indicators, scenarios and visualisations should be interpreted in light of their stated purpose, methodology, assumptions, data, publication date and limitations.

A simulation or scenario explores selected possibilities under specified conditions; it is not a promise or reliable prediction of future events. Outputs may change materially when assumptions, inputs, methods or external conditions change. Correlation, model fit or a plausible mechanism does not, on its own, establish causation or suitability for a particular application.

Exploratory work, prototypes and concepts described as under development should not be treated as independently validated, peer reviewed or ready for operational use unless the relevant documentation expressly establishes that status. The absence of an express limitation does not establish validation.

Before operational use, assess data quality, uncertainty, sensitivity, validation and the need for independent expert review and human oversight. Public demonstrations are not designed for safety-critical use or automated decisions affecting individuals' rights without separate assessment and appropriate safeguards.

5. Permitted use of website materials

Unless a resource carries a different licence, you may view the website and download or print reasonable extracts of Zinkea's own publicly available text for personal study, teaching, research and internal business reference. Retain attribution, publication details and applicable notices, and do not present altered material as Zinkea's original work.

You may share links to public pages and make quotations permitted by applicable law. These permissions do not authorise commercial republication, resale, systematic redistribution or reproduction of substantial parts of the website. Contact info@zinkea.com for permission where your intended use is not covered.

Nothing in these terms restricts uses allowed by mandatory law, including applicable quotation, accessibility, research and text-and-data-mining exceptions. A resource's express open licence governs the rights it grants.

6. Intellectual property and third-party licences

Rights in original website text, graphics, design, models and other materials belong to Zinkea or the relevant rights holders. Access does not transfer ownership or grant rights beyond those expressly stated or provided by law.

Third-party publications, datasets, software, code, images and linked repositories remain subject to their respective licences and rights. A link, citation or availability for download does not by itself authorise reuse. Consult the applicable licence, attribution and any source-specific restrictions.

Do not use Zinkea's name, branding or materials in a way that falsely suggests endorsement, certification, affiliation or approval. These terms do not prevent accurate attribution or other lawful referential use.

7. Responsible use and website security

Use the website lawfully and respect the rights and security of others. In particular, do not:

Ordinary indexing by search engines and uses permitted by law or an express licence are not prohibited by these terms. If you discover a vulnerability, report it to info@zinkea.com with enough detail to identify the issue, without accessing or disclosing others' data.

8. Enquiries and submitted information

Provide accurate contact details and only submit information you are entitled to share. Avoid sending trade secrets, confidential business documents, sensitive personal data or material subject to third-party restrictions through the public contact form. Contact us first to arrange an appropriate channel and, where needed, confidentiality terms.

You retain your rights in material you submit. Sending an enquiry does not grant us a general right to publish it or acquire your intellectual property. We may handle the information as reasonably necessary to assess and respond to your request, subject to applicable law, our Privacy Policy and any confidentiality obligations.

An unsolicited enquiry does not itself create a negotiated non-disclosure agreement. This does not remove protections or duties that arise under applicable law. We cannot guarantee acceptance of an enquiry, availability for a project or a particular response time.

9. Privacy and website technologies

Our Privacy Policy at /privacy/ explains how we handle personal data, including information sent through the contact form. Read it before submitting personal information.

These terms do not constitute consent to marketing, optional cookies or processing that requires a separate legal basis or consent. Any resource-specific privacy information or consent request will be provided where required.

10. External resources and references

Links and references may direct you to independent publications, repositories, datasets, institutions and other third-party websites. Their availability and inclusion do not imply endorsement, a commercial relationship or validation of every statement they contain.

Third parties control their own content, services, licences and privacy practices. Review their terms before using their resources. We do not guarantee that external content remains available, accurate or secure. Nothing in this section excludes responsibility imposed on us by applicable law.

11. Availability, accuracy and corrections

We aim to present materials carefully, but the website may contain errors or material that becomes outdated. Except where law or a separate agreement requires otherwise, we do not promise uninterrupted availability, error-free operation, complete coverage or suitability for a particular purpose.

We may update, correct, relocate or withdraw public materials and interrupt access for maintenance, security or operational reasons. Where practicable, we will give notice of a significant planned interruption. These changes do not alter obligations under a separate professional agreement.

Please report material errors, broken links or accessibility difficulties to info@zinkea.com, identifying the relevant page and issue.

12. Responsibility and limitations

You are responsible for assessing whether general website materials are appropriate for your intended use and for taking reasonable precautions when downloading files or using external resources.

To the extent permitted by applicable law, Zinkea is not responsible for business losses arising solely from reliance on general website materials as though they were advice commissioned for your circumstances, or for losses caused by circumstances outside our reasonable control. Any exclusion applies only where legally valid in the circumstances and does not excuse a duty or breach for which the law holds us responsible.

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing removes statutory consumer rights or remedies. Liability for separately commissioned work is governed by its agreement and mandatory law.

13. Links to this website and rights concerns

You may link to publicly available pages provided the presentation is lawful, accurate and does not imply endorsement or affiliation. Do not frame the website or present its content as your own without permission.

If you believe content infringes a right, is unlawful or materially misrepresents your work, contact info@zinkea.com with the relevant URL, an explanation, supporting information and a means of contacting you. We will assess the concern and take appropriate action.

We may take proportionate steps to restrict abusive or unlawful access, protect the service or comply with legal obligations, subject to applicable law.

14. Changes to these terms

Revisions will be published on this page with an updated date. Changes apply prospectively and will not retrospectively alter an existing professional engagement, an accrued right or a licence already granted, except where applicable law or a valid agreement provides otherwise.

Where a change requires notice or express agreement by law, publication alone does not replace that requirement.

15. Applicable law and disputes

These terms and website-related disputes are governed by Spanish law, subject to applicable conflict-of-law rules and mandatory protections.

If you are a consumer, this choice does not deprive you of mandatory protections available under the law applicable to you. The courts with jurisdiction are determined by applicable law; these terms do not require you to waive a competent consumer forum or submit to compulsory private arbitration.

Please contact us first if you wish to raise a concern so that we can try to resolve it. This is not a mandatory prerequisite to legal action and does not restrict statutory remedies or time limits.

16. General provisions and contact

If a provision is invalid or unenforceable, its consequences and the continued application of the remaining provisions will be determined by applicable law. Failure to enforce a provision on one occasion does not by itself waive a right on another occasion.

For questions about these terms, reuse permissions or website concerns, contact Zinkea Business Consulting, S.L. at info@zinkea.com or at Avda. de la Vía Láctea s/n, San Fernando de Henares (Madrid, Spain).
